Breaking: Court Strike Out Suit Against 44 LG’s Interim Managers in Kano

Justice A. M Liman of Federal high court in Kano has stroke out the suit challenging the constitution of 44 local council Interim Managing Committees appointed by Kano state government.

Governor Abba Kabir Yusuf on Friday inaugurated the 44 interim managers to resume the control of local council administration of the state following the expiration of the duly elected Chairmen.

Prior to the inauguration of the caretakers, one Haruna Abba Babbangi filed an exparte motion restraining Governor Yusuf, Kano state House of assembly, Kano Attorney General and Commissioner of Justice and three defendants from carrying out the action.

The court also granted the motion stopping Accountant General of the Federation from releasing Kano local government council’s fund to the state government.

In a ruling delivered on Thursday, Justice Liman declared that the dismissal followed the action of the applicant’s motion on notice announcing the withdrawal of the case against the state.

Justice Liman ruled that the court has prejudice to strike out the suit after the indication of the applicant notice.

A mild drama however ensued when council to the applicant, Barrister Abdul Fagge denied knowledge of the decision of his client to withdraw the case pending before the court.

Barrister Fagge told the court that striking out the matter may not be justifiable since the exparte order earlier granted has not been vacated.

On his part, council to the six defendants H. H Sulaimon, a deputy director, Civil litigation confirmed the reception of the notice of withdrawal of the applicant.
