Nasarawa: Appeal Court Sets Date for Gov Sule’s Appeal Hearing

The Court of Appeal has scheduled Wednesday, 15th November for the hearing of the appeal filed by Nasarawa State Governor Abdullahi Sule.

The governor is challenging the majority decision of the Governorship Election Petition Tribunal that favored the candidate of the Peoples Democratic Party (PDP), David Ombugadu.

The notice of hearing was issued by Nasiru Alhassan, the Electronic Desk Officer of the court.

The hearing is set to commence at 9 am at the Court of Appeal, Abuja Division.

Governor Sule had filed the Notice of Appeal on Sunday, October 15, 2023, through his lead Counsel, Chief Wole Olanipekun, SAN.

The appeal follows a split judgement by the governorship election petition tribunal in Lafia, which declared David Ombugadu as the lawful winner of the March 18 governorship election in Nasarawa State.

Rejecting the majority judgement, Governor Sule described its position as unmeritorious and devoid of evidential support, vowing to appeal the decision.

In the Notice of Appeal, the governor raised 27 grounds for determination, questioning the tribunal’s jurisdictional competence and highlighting failures to adhere to constitutional and electoral provisions.

He argued that the tribunal lacked the competence to order Ombugadu’s immediate swearing-in, emphasizing that the majority decision failed to consider relevant constitutional and electoral provisions.

Governor Sule urged the Appellate Court to set aside the decision of the lower court and affirm his election victory as declared by the Independent National Electoral Commission (INEC).

The appeal involves parties including David Ombugadu, PDP, INEC, and the All Progressives Congress (APC) as 1st, 2nd, 3rd, and 4th respondents, respectively.
