Again, Court Orders Immediate Release of Former CBN Governor

Justice Olukayode Adeniyi of the High Court, Federal Capital Territory (FCT), reaffirmed his earlier order today, instructing the Economic and Financial Crimes Commission (EFCC) to either release former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, or bring him before the court for bail.

The judge had on November 2 given the order following Emefiele’s appeal that the federal agencies violated his fundamental right.

Emefiele had included the Federal Government, the Attorney-General of the Federation, the Executive Chairman of the EFCC, and the anti-corruption commission as respondents in the case.

However, during the recent hearing, Emefiele’s counsel, Mathew Burkaa SAN, informed the court that the third and fourth respondents had not yet complied with the court’s order.

According to the senior advocate, as of today, the applicant had spent 149 days in the custody of the respondents.

Counsel for the third and fourth respondents, Farouk Abdullah, confirmed to the court that they received the court order.

He told the court that the applicant’s processes were served on them and he wanted to respond with a view to setting the record straight but could not do so due to the fact that the processes were incomplete.

According to him, the affidavit filed by the applicant showed that certain exhibit referred to, particularly Exhibit B, which he said was referred to in Paragraph 20 of the affidavit, was not attached.
