The National/State House of Assembly Election Petition Tribunal, seated in Kano, has dismissed the petition filed by Kabir Ibrahim Gaya, representing the All Progressive Congress (APC).
Gaya’s petition had challenged the victory of Abdulrahman Kawu Sumaila of the New Nigeria People Party (NNPP) in the Kano South senatorial election, citing gross incompetence as grounds for contestation.
The tribunal, led by Chairman Justice R.O Odogu and two other justices, has upheld its decision, asserting that the petitioner was unable to meet the required burden of proof.

Justice Odogu said, “We find no merit in this petitioner and accordingly hereby dismissed.”
The tribunal also stated, “We similarly affirmed the declaration of Abdulrahman Kawu Sumaila of NNPP as winner and valid of the Kano South Senatorial District election, held on 25th Feb. 2023.”
Consequently, Justice Odogu pronounced that “the sum of N200,000 cost be awarded in favour of the respondents against the petitioner.”
